These Terms govern access to and use of lowprop.com (the "Site"), which is operated by LowerHoldings, LLC under the trade name LowProp. By using the Site, you agree to these Terms.

About the Site

The Site exists to share information about LowerHoldings, LLC's rental portfolio, available units, and acquisition interests. Nothing on the Site constitutes a legal offer, a brokerage representation, financial advice, tax advice, or a commitment to lease, purchase, or sell any property.

No brokerage relationship

LowerHoldings, LLC is a property owner-operator, not a real estate broker or agent. We do not represent buyers, sellers, landlords, or tenants other than the LLC itself. Communications submitted through the Site do not create a fiduciary or agency relationship.

Listings

Property availability, rents, terms, photos, and descriptions are provided for informational purposes and are subject to change without notice. Discrepancies between the Site and the actual property condition or lease terms are governed by the executed lease and applicable disclosures.

You may not reproduce, distribute, or create derivative works from the Site without written permission, except for fair use such as a screenshot for journalistic or due-diligence purposes.

Third-party links

The Site may link to third-party services (for example, the Baselane application portal). We are not responsible for the content, terms, or privacy practices of third-party sites.

No warranty

The Site is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Limitation of liability

To the fullest extent permitted by law, LowerHoldings, LLC and its members, managers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Site.

Governing law and venue

These Terms are governed by the laws of the State of Iowa, without regard to conflict-of-law principles. Any dispute arising from or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Johnson County, Iowa.

Changes

We may update these Terms at any time. Continued use of the Site after a change constitutes acceptance of the revised Terms.
